L.M. Motors Car Sales

Terms and conditions

Vehicle sales terms and conditions of L.M Motors Ltd. Effective date: 27 August 2026.

These Terms and Conditions apply to vehicles sold by L.M Motors Ltd ("L.M Motors", "we", "us", "our") to the purchaser identified on the vehicle invoice/order form ("the Customer", "you", "your"). These Terms form part of the contract of sale. Nothing in these Terms is intended to exclude, restrict or reduce any mandatory rights available to a consumer under Irish law, including the Consumer Rights Act 2022.

1. Definitions

For the purposes of these Terms:

“Vehicle” means the motor vehicle identified on the invoice, sales agreement or order form.

“Customer” means the person or entity purchasing the Vehicle.

“Consumer” means a person purchasing primarily for purposes outside their trade, business, craft or profession.

“Business Customer” means a person, company, motor trader or other entity purchasing primarily in connection with a trade or business.

“Delivery” means the time at which possession of the Vehicle is transferred to the Customer.

“Major Fault” includes a fault which may affect the safe operation of the Vehicle or which, if the Vehicle continues to be driven, may cause substantial additional mechanical damage.

2. Used vehicle condition

The Customer acknowledges that the Vehicle is a used motor vehicle unless specifically stated otherwise on the invoice.

The Customer understands that the condition reasonably expected of a used Vehicle depends on matters including its age, mileage, purchase price, previous use, service history, general condition and normal wear and tear.

A used Vehicle cannot reasonably be expected to be in the same condition as a new vehicle. Reasonable deterioration, cosmetic imperfections and wear associated with the Vehicle’s age and mileage do not, by themselves, constitute a defect.

Nothing in this section affects the Customer’s statutory rights.

3. Vehicle description

L.M Motors will take reasonable steps to ensure that Vehicle advertisements and descriptions are accurate.

The Vehicle registration number, VIN/chassis number and mileage recorded on the final sales invoice or vehicle order form shall take precedence over any accidental typographical error in an advertisement.

Where any particular feature, specification, service history, previous ownership status or other characteristic is especially important to the Customer, the Customer should request written confirmation before completing the purchase.

4. Mileage

The Vehicle’s odometer reading at the point of sale will be recorded on the sales invoice where practicable.

Unless L.M Motors expressly guarantees the mileage in writing, mileage is stated as the odometer reading displayed by the Vehicle and based upon the information reasonably available to L.M Motors.

Nothing in this clause permits L.M Motors to knowingly or recklessly provide inaccurate mileage information.

5. Customer inspection and test drive

Before purchasing the Vehicle, the Customer is strongly encouraged to inspect and test-drive the Vehicle, check the bodywork, interior, tyres, wheels, warning lights, service history, NCT status, equipment and accessories, and arrange an independent mechanical inspection if desired.

L.M Motors will reasonably facilitate an independent pre-purchase inspection where arrangements are agreed in advance.

Acceptance of the Vehicle following inspection does not remove statutory rights relating to faults which the Customer could not reasonably have been expected to discover or which L.M Motors was legally required to disclose.

6. Known faults and disclosed defects

Any material fault or defect known to L.M Motors and specifically disclosed to the Customer before the contract is entered into should be recorded on the sales documentation where appropriate.

Where a specific defect is clearly brought to the Customer’s attention before purchase, the Customer is given the opportunity to consider it, and the Customer expressly agrees to purchase the Vehicle with that defect, the Customer cannot subsequently treat that specific disclosed defect itself as an undisclosed fault.

This provision does not apply to any different or undisclosed defect.

7. Statutory consumer rights

Where the Customer is a consumer, the Vehicle will be supplied in accordance with applicable Irish consumer legislation, including the Consumer Rights Act 2022.

Nothing contained in an L.M Motors warranty, guarantee, invoice or these Terms and Conditions replaces or limits the Customer’s statutory rights.

8. Faults arising after purchase

If a problem develops after purchase, the Customer must notify L.M Motors as soon as reasonably practicable after discovering the problem.

The Customer should provide the Vehicle registration, current mileage, description of the problem, photographs or videos where relevant, warning lights or messages displayed, circumstances in which the problem occurred, and any diagnostic information available.

Early notification is particularly important where continuing to operate the Vehicle could cause further damage.

9. Major mechanical problems - stop driving

If the Vehicle develops symptoms indicating a potentially serious mechanical or safety problem, the Customer must take reasonable steps to prevent further damage.

Such symptoms may include overheating, loss of coolant, low oil pressure warning, severe engine knocking, significant smoke, major transmission malfunction, brake failure, serious steering problems, oil or fuel leakage, abnormal engine temperature, red dashboard warning lights, severe loss of power or any circumstance where continued driving could reasonably cause serious additional damage.

The Customer should stop driving the Vehicle where it is unsafe or where continued driving may cause additional damage and contact L.M Motors promptly. Where appropriate, the Vehicle should be recovered rather than driven.

10. 250 km / continued-use condition

Where the Customer reports a potentially serious or major fault, or where L.M Motors advises the Customer that continued driving may cause additional damage, the Customer must give L.M Motors a reasonable opportunity to inspect the Vehicle and must not unreasonably continue using it.

Once L.M Motors has requested that the Vehicle be returned, inspected, recovered or that its use be restricted because of a suspected serious fault, the Customer should limit any further use to what is reasonably necessary.

Where the Customer drives more than 250 kilometres after notification of the suspected major fault or after being advised by L.M Motors to restrict or cease use, such continued mileage may be taken into account when assessing whether further damage was caused, responsibility for additional repairs, abnormal depreciation, and any lawful deduction permitted by Irish law.

Where legally permissible and where the additional mileage has caused or represents a genuine additional loss or depreciation to L.M Motors, L.M Motors reserves the right to seek a charge or deduction calculated at €0.50 per kilometre for mileage exceeding the first 250 kilometres.

This €0.50 per kilometre provision shall not automatically reduce or defeat any statutory refund or other remedy where Irish consumer law does not permit such a deduction.

L.M Motors may additionally seek recovery of demonstrable damage caused by continuing to operate the Vehicle contrary to a reasonable instruction to stop driving or where the Customer knew or reasonably ought to have known that continuing to drive was likely to cause further damage.

11. Opportunity to inspect and repair

Where legally applicable and subject to the Customer’s statutory rights, L.M Motors must be given a reasonable opportunity to inspect the Vehicle, diagnose the reported problem and provide an appropriate remedy.

The Customer must make the Vehicle reasonably available to L.M Motors where a repair, inspection or other remedy is being considered. L.M Motors may require diagnostic testing before accepting that a particular component is defective.

12. Unauthorised third-party repairs

Except in a genuine emergency, the Customer should not authorise another garage, mechanic or third party to carry out substantial repairs for which the Customer intends to seek reimbursement from L.M Motors without first contacting L.M Motors and giving L.M Motors a reasonable opportunity to inspect and address the problem.

L.M Motors is not automatically responsible for third-party repair invoices which it did not authorise. This does not remove a statutory entitlement the Customer may have to recover reasonable costs where the law permits.

13. Diagnostic reports

A diagnosis provided by another garage does not automatically establish liability against L.M Motors. L.M Motors may inspect the Vehicle itself, obtain its own diagnostic report, seek an independent assessment or request further information concerning the alleged fault.

Both parties should preserve relevant evidence where a mechanical dispute arises.

14. Repairs

Where L.M Motors is legally required or otherwise agrees to repair a Vehicle, the repair will be carried out within a reasonable period and using appropriate replacement or reconditioned components where suitable.

There is no automatic entitlement to insist on new manufacturer-supplied components for an older used Vehicle where a suitable quality replacement or reconditioned component provides an appropriate repair, provided the repair complies with applicable law.

15. Replacement vehicles / courtesy cars

Unless separately agreed in writing, purchase of a Vehicle does not automatically include an entitlement to a courtesy car while the Vehicle is being inspected or repaired.

Where L.M Motors voluntarily provides a courtesy vehicle, separate conditions regarding insurance, fuel, mileage, damage and use may apply.

16. Normal wear and tear

L.M Motors is not responsible for problems arising solely from reasonable normal wear and tear after purchase.

Depending on the Vehicle’s age, mileage and condition, consumable or service items may include tyres, brake pads, brake discs, bulbs, wiper blades, filters, oils and fluids, clutches where failure results from ordinary wear or driver use, batteries where deterioration is consistent with age/use, exhaust components subject to ordinary deterioration, suspension bushes, shock absorbers, cosmetic trim, minor rattles and squeaks and similar items.

A component being a wear item does not automatically exclude liability where evidence demonstrates that the Vehicle failed to meet the legal standard required at the time of sale.

17. Customer damage, misuse and neglect

L.M Motors will not be responsible for a fault or damage caused after delivery by accident, collision, misuse, abuse, racing, negligent driving, failure to maintain sufficient oil or coolant, continuing to drive while overheating, ignoring serious dashboard warnings, incorrect fuel, modifications, remapping, improper towing, overloading, flood damage, potholes, kerbs, unauthorised mechanical work, inadequate servicing or continued use after a serious mechanical problem becomes apparent where that use causes additional damage.

18. Servicing and maintenance

The Customer is responsible for maintaining the Vehicle appropriately following delivery, including checking engine oil, coolant, tyre pressures, responding appropriately to dashboard warnings and following applicable service intervals.

Failure to maintain the Vehicle does not automatically extinguish statutory rights. However, where L.M Motors can establish that a fault or additional damage resulted from inadequate maintenance, neglect or misuse after delivery, L.M Motors will not be responsible for damage attributable to that conduct.

19. Timing belts, timing chains and service items

Unless expressly confirmed in writing, L.M Motors does not represent that a timing belt, timing chain, gearbox service, clutch, dual-mass flywheel or any other particular maintenance item has previously been replaced merely because the Vehicle has a service history.

Customers should rely upon documentary evidence supplied with the Vehicle. This provision does not exclude responsibility for a pre-existing defect that makes the Vehicle non-conforming at the time required by law.

20. DPF, EGR and emissions systems

Modern diesel Vehicles may contain diesel particulate filters (DPF), exhaust gas recirculation systems (EGR), AdBlue/SCR systems, NOx sensors, particulate sensors and related emissions equipment. Their operation may be affected by driving patterns, servicing and Vehicle use.

L.M Motors will not be responsible for problems caused after sale solely by unsuitable use, modification, inadequate maintenance or failure to respond appropriately to warning lights. Statutory rights remain unaffected in relation to pre-existing defects.

21. NCT

Where a Vehicle is supplied with a current NCT certificate, that certificate confirms only that the Vehicle satisfied the applicable NCT requirements at the time of the test. An NCT certificate is not a guarantee against future mechanical failure and does not replace L.M Motors’ obligations under consumer law.

22. Service history

Any service history supplied with the Vehicle is passed to the Customer based upon records available to L.M Motors. Unless expressly stated otherwise in writing, L.M Motors does not guarantee that every service performed throughout the Vehicle’s lifetime is documented.

23. Vehicle history

L.M Motors will not knowingly sell a Vehicle subject to outstanding finance which prevents lawful transfer of ownership. Any significant history known to L.M Motors which is legally required to be disclosed will not knowingly be concealed.

Third-party history reports may be provided for convenience but remain subject to the accuracy of information supplied to those third-party databases.

24. Deposits

A Vehicle may be reserved upon payment of an agreed deposit. Unless otherwise agreed in writing, the deposit reserves the Vehicle for the period agreed between L.M Motors and the Customer.

Where the Customer simply changes their mind in circumstances where there is no statutory cancellation right and L.M Motors has reasonably relied upon the reservation, a deposit may be non-refundable to the extent permitted by law and having regard to actual losses suffered.

Where L.M Motors cannot complete the sale through no fault of the Customer, any deposit will normally be returned. Nothing in this clause affects any mandatory cancellation or refund right under Irish law.

25. Change of mind

Where a Customer purchases a Vehicle at L.M Motors’ premises, there is generally no automatic right to return the Vehicle simply because the Customer changes their mind, subject to applicable law.

This does not affect rights where the Vehicle is faulty, materially misdescribed or otherwise fails to conform to the sales contract.

26. Distance and off-premises sales

Where a legally qualifying distance or off-premises contract is entered into, L.M Motors will comply with applicable statutory cancellation requirements.

27. Trade-in vehicles

Where L.M Motors accepts a Vehicle as a trade-in, the Customer warrants that they own the trade-in or have authority to dispose of it, that information supplied concerning it is accurate, that any outstanding finance and known material defects have been disclosed, and that the mileage has not knowingly been misrepresented.

The trade-in allowance may be reconsidered if information supplied by the Customer proves materially incorrect or the Vehicle’s condition materially deteriorates before completion.

28. Finance sales

Where the Vehicle is acquired using finance, separate agreements may exist between the Customer and the finance provider. Finance approval is at the discretion of the finance provider and L.M Motors cannot guarantee approval.

29. Ownership and payment

Ownership of the Vehicle will not pass to the Customer until L.M Motors has received cleared funds for the full amount due, subject to the terms of any applicable finance agreement.

30. Payment reversals and chargebacks

A Customer should not knowingly initiate an unjustified payment reversal or chargeback where the Vehicle has been supplied and no lawful basis for reversal exists.

Nothing in this provision prevents a Customer from exercising a legitimate statutory, contractual or card-scheme right. L.M Motors reserves the right to provide relevant evidence in response to any chargeback.

31. Customer responsibility after delivery

From the point of delivery, the Customer is responsible for ensuring the Vehicle is appropriately insured, appropriately taxed where required, driven by appropriately licensed persons, operated lawfully, maintained appropriately and kept secure.

The Customer is responsible for fines, tolls, parking charges, penalties and offences arising from their use of the Vehicle after delivery.

32. Modifications after sale

Any modification performed after delivery is undertaken at the Customer’s own risk. This includes engine remapping, ECU tuning, DPF deletion, EGR deletion, exhaust modification, suspension modification, aftermarket wheels, performance upgrades, electrical modifications and non-standard software.

Where a fault is caused by or materially contributed to by an after-sale modification, L.M Motors will not be responsible for that fault.

33. Accidents after sale

L.M Motors is not responsible for defects or damage caused by an accident, collision or other external event occurring after delivery.

34. Inspection following a complaint

Where a complaint is made, L.M Motors may inspect relevant parts of the Vehicle before deciding whether responsibility is accepted.

The Customer should not dispose of, dismantle or destroy an allegedly defective component where doing so would materially prevent reasonable investigation of the claim. Where parts have already been replaced, the Customer should request that the garage retain the relevant components where reasonably possible.

35. Customer’s duty to mitigate loss

Both L.M Motors and the Customer should take reasonable steps to avoid unnecessary loss where a dispute or mechanical issue arises. A Customer should therefore not deliberately or unreasonably continue driving a Vehicle where doing so is likely to cause significantly greater damage.

36. Consequential and indirect loss

To the maximum extent permitted by law, L.M Motors shall not be responsible for indirect or consequential losses which were not reasonably foreseeable when the contract was entered into.

Nothing in these Terms excludes liability where exclusion is prohibited by law, including liability for death or personal injury caused by negligence where such liability cannot lawfully be excluded.

37. Personal items

Customers are responsible for removing personal belongings from Vehicles left with L.M Motors. L.M Motors will take reasonable care but is not responsible for loss of personal property except where liability arises through negligence or other legal responsibility.

38. Vehicles left for repair or inspection

Where a Vehicle is left with L.M Motors for inspection or repair, the Customer authorises L.M Motors to carry out reasonable diagnostic testing, including road testing where necessary. Reasonable mileage may therefore be added for diagnostic or testing purposes.

39. Collection following repair

The Customer should collect the Vehicle within a reasonable period after being notified that inspection or agreed repairs have been completed.

Where a Vehicle remains uncollected for an excessive period, L.M Motors reserves the right, following reasonable notice and to the extent permitted by law, to charge reasonable storage costs.

40. Warranties provided by L.M Motors

Where L.M Motors provides a separate commercial warranty, the duration and scope of that warranty will be recorded separately.

Any commercial warranty is additional to the Customer’s statutory consumer rights and does not replace them.

Expiration of a three-month or other commercial warranty does not itself extinguish rights which a Customer may have under Irish consumer legislation.

41. Warranty exclusions

Where a separate commercial warranty is supplied, its voluntary additional cover may exclude routine servicing, consumables, reasonable wear and tear, tyres, brake pads, brake discs, bulbs, wiper blades, cosmetic damage, misuse, accident damage, modification, damage resulting from failure to stop driving after a serious warning, and faults caused by inadequate maintenance after purchase, provided always that these exclusions do not restrict the Customer’s independent statutory rights.

42. No automatic refund for every fault

The existence of a fault does not mean that every case automatically results in cancellation of the contract. The appropriate remedy will depend upon the nature and seriousness of the fault, when it arose, whether it existed or is legally presumed to have existed at the relevant time, whether repair or replacement is appropriate, whether previous repair attempts have failed and the remedies available under applicable law.

Where Irish consumer law gives the Customer an immediate statutory right to terminate the contract, these Terms do not remove that right.

43. First 30 days

Where a qualifying lack of conformity becomes apparent and the Customer has the statutory short-term right to terminate the contract under the Consumer Rights Act 2022, L.M Motors will respect that right.

Nothing in these Terms requires a consumer to accept a repair instead of exercising a statutory right to terminate where the law gives them that right.

44. Refunds and vehicle return

Where the Customer is legally entitled to terminate the sales contract, the Vehicle must be returned or made available in accordance with applicable law.

The Customer should return all keys, Vehicle documentation and accessories supplied, remove personal belongings and disclose any accident or damage occurring since delivery.

Refunds will be processed in accordance with applicable statutory requirements. No administration, mileage or other charge will be imposed where doing so would unlawfully reduce a statutory refund.

45. Excessive or abnormal use before final termination

Where the law permits a reduction to a reimbursement because the Vehicle has suffered depreciation beyond that reasonably expected from normal use, L.M Motors reserves the right to rely upon such a reduction.

Relevant evidence may include mileage accumulated, physical damage, tyre damage, accident damage, mechanical damage caused after delivery, deterioration caused by misuse, continued driving following a major warning and other abnormal depreciation.

Where mileage forms part of that calculation, the €0.50 per kilometre rate referred to in Clause 10 may be used as an agreed reference for calculating the value of abnormal additional use where lawful and objectively justifiable.

46. Business-to-business / trade sales

Where the purchaser is genuinely buying the Vehicle primarily in the course of their motor trade or other business, consumer-specific statutory protections may not apply in the same manner.

A vehicle will not be treated as a private or trade sale merely to circumvent mandatory consumer legislation.

47. Complaints procedure

Customers experiencing a problem should contact L.M Motors as soon as reasonably practicable and provide the Vehicle registration, mileage and details of the complaint.

L.M Motors will review the matter and may arrange initial discussion, Vehicle inspection, diagnosis, repair or other remedy where appropriate, and further assessment if the parties disagree.

48. Communication

For the purposes of resolving mechanical or contractual issues, communication may be made by telephone, SMS, WhatsApp, email or written correspondence.

Important mechanical complaints should preferably also be confirmed in writing so that there is a clear record of when the problem was reported, the mileage, symptoms, instructions given by L.M Motors and arrangements for inspection.

49. Data protection

L.M Motors may collect and process Customer personal information reasonably necessary for completion of the Vehicle sale, vehicle registration/ownership procedures, finance administration, accounting and taxation, warranty administration, fraud prevention, legal compliance and handling complaints.

Personal information will be handled in accordance with applicable Irish and EU data-protection law, including the GDPR and Data Protection Act 2018.

50. Governing law

These Terms and Conditions and any sale concluded with L.M Motors are governed by the laws of Ireland.

Nothing in this provision removes any mandatory right a consumer has regarding jurisdiction or dispute resolution.

51. Severability

If any provision of these Terms is found by a court or competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as modified or removed only to the extent necessary. The remaining provisions shall continue to apply.

52. Statutory rights take priority

These Terms and Conditions are intended to clarify the contractual relationship between L.M Motors and the Customer and to protect both parties against unreasonable or improper claims.

They are not intended to contract out of Irish consumer law. If any provision conflicts with a mandatory statutory consumer right, the statutory right shall prevail.

Important customer notice

If a serious mechanical problem develops, contact L.M Motors immediately. Do not continue driving if the Vehicle is overheating, has low oil pressure, is losing coolant or oil, displays a serious red warning, has significant brake/steering problems, or if continued driving could reasonably cause additional damage.

Where L.M Motors requests that a Vehicle be returned or that driving cease because a serious fault is suspected, continued use may cause additional damage for which L.M Motors may not be responsible.
